Terms of Service

1. Eligibility and Accounts

You must be at least 13 years old to use Night Finder. If you are under the age of legal majority where you live, you represent that your parent or legal guardian has permitted your use. You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity conducted through your account.

2. Purpose of Night Finder

Night Finder is a community platform for sharing and discussing reports of unusual or unexplained experiences. User reports are not verified facts, scientific findings, emergency information, or professional advice. Status labels and community activity do not guarantee that any report is true, accurate, safe, or complete.

3. Safety and Location Rules

• Do not trespass or enter restricted, abandoned, or unsafe property.
• Do not interfere with emergency personnel, investigations, property owners, or wildlife.
• Do not use Night Finder while driving or in a way that distracts you from hazards.
• Do not rely on Night Finder for emergencies, navigation, rescue, weather, health, or public-safety decisions.
• Call the appropriate emergency service when anyone may be in danger.

You assume the risks of visiting any location mentioned in the service. Approximate map markers may be incomplete or inaccurate and are not invitations or permissions to enter property.

4. User Content

You retain ownership of content you submit, such as sightings, comments, profile information, and photos. You grant Night Finder a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify for technical formatting, display, distribute, and otherwise use that content as reasonably necessary to operate, secure, promote, and improve the service. This license ends when the content is deleted except where continued retention is legally permitted or technically necessary for limited backups, logs, or resolving disputes.

You represent that you have the rights and permissions needed to submit your content and that it does not violate another person's privacy, publicity, copyright, trademark, or other rights.

5. Prohibited Content and Conduct

You may not use Night Finder to:

• Threaten, harass, stalk, exploit, impersonate, or endanger anyone.
• Post illegal, hateful, sexually exploitative, excessively violent, or deliberately harmful content.
• Expose precise private locations, personal information, or confidential information without authorization.
• Post spam, scams, malware, deceptive promotions, or knowingly fabricated evidence intended to harm or defraud.
• Infringe copyrights, trademarks, or other intellectual-property rights.
• Attempt to bypass security, access another account, scrape the service, disrupt operations, or misuse automated systems.
• Use information from Night Finder to trespass, intimidate, discriminate, or commit an unlawful act.

6. Moderation and Reporting

Users may report sightings and comments. We may review, restrict, remove, preserve, or disclose content; limit features; suspend or terminate accounts; or refer matters to appropriate authorities when reasonably necessary. We are not obligated to monitor every post and do not guarantee that reported material will be removed. Repeatedly submitting false or abusive reports may itself violate these Terms.

7. Intellectual Property

Night Finder's software, branding, interface, and original service content are owned by Night Finder or its licensors and are protected by applicable law. These Terms do not grant permission to copy, reverse engineer, sell, sublicense, or create a competing service from protected Night Finder materials, except where applicable law expressly allows it.

To report claimed infringement, email us with your contact details, identification of the protected work, the location of the disputed material, the basis for your claim, and any legally required statements.

8. Third-Party Services

Night Finder relies on third-party services, including hosting, authentication, storage, mapping, and app-distribution providers. Their services may be governed by separate terms. We are not responsible for third-party services or content outside our control.

9. Changes, Availability, and Termination

We may add, modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted or error-free availability. You may stop using Night Finder or delete your account. We may restrict or terminate access for violations, legal requirements, security risks, harm to others, or discontinuation of the service. Provisions that by their nature should survive termination will remain in effect.

10. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIGHT FINDER IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, SAFETY, AND AVAILABILITY. WE DO NOT ENDORSE OR VERIFY USER CONTENT OR GUARANTEE THE EXISTENCE, NATURE, OR EXPLANATION OF ANY REPORTED EVENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NIGHT FINDER AND ITS OPERATORS, CONTRIBUTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, PROFITS, REVENUE, GOODWILL, PERSONAL INJURY, PROPERTY DAMAGE, OR LOSSES ARISING FROM USER CONTENT, LOCATIONS, THIRD-PARTY CONDUCT, OR USE OF OR INABILITY TO USE THE SERVICE. RIGHTS THAT CANNOT LEGALLY BE LIMITED REMAIN UNAFFECTED.

12. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Night Finder and its operator from claims, liabilities, damages, and reasonable costs arising from your content, your conduct, your violation of these Terms, or your violation of another person's rights.

13. Governing Law

These Terms are governed by the laws of the State of North Carolina and applicable United States law, without regard to conflict-of-law rules. Any dispute not subject to another legally required forum will be brought in a court of competent jurisdiction in North Carolina. Nothing in these Terms removes consumer rights that cannot be waived.

14. Changes to These Terms

We may update these Terms as Night Finder changes. We will revise the effective date and provide additional notice when required. Your continued use after updated Terms take effect constitutes acceptance of the updated Terms.
